SMS / Text Messaging Terms

This page describes the terms of service for SMS/text messages sent by our clients, as licensees of the DSP Pilot program (“clients”), through the DSP Pilot platform for the internal operations of their businesses.

To consent to receive SMS/text messages through DSP Pilot, our clients’ employees must provide their mobile phone numbers during onboarding and affirmatively opt-in to receive recurring SMS/text messages from their employers for operational, coaching, safety, and scheduling purposes.

Our clients are solely responsible for ensuring compliance with all laws applicable to sending SMS/text messages to employees through the DSP Pilot platform, including obtaining proper opt-in consents and offering valid opt-out procedures. We do not procure, maintain, or store opt-in or opt-out records on behalf of clients. Opt-in compliance and record-keeping is the sole responsibility of clients, who expressly indemnify and hold DSP Pilot and its owners harmless from any liability due to a failure to do so.

Clients and their owners, management staff, and employees may only use the DSP Pilot platform to send valid SMS/text messages relating to their business operations. Clients are expressly prohibited from sending solicitations, personal or non-business related, or unlawful messages to their employees through DSP Pilot. Any unauthorized use by a client, its agents or employees of the SMS/text messaging service provided in the DSP Pilot platform is expressly prohibited, constitutes a violation of the Terms of Service, and may result in termination of the client’s license.

We do not share, sell, or rent phone numbers or SMS message content to third parties. Opt-in consents are never shared with affiliates or marketing partners, and all mobile information of clients’ employees is kept confidential. We do not guarantee compatibility of SMS/text messaging with any carrier. Currently, SMS/text messaging through the DSP Pilot platform is supported by the following carriers: AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Boost, Virgin Mobile, Cricket, MetroPCS. Carriers are not liable for undelivered messages, and we are not responsible for any carrier charges to recipients of SMS/text messages sent through DSP Pilot.
